			<content:encoded><![CDATA[<p>Warning: highly technical question for a land trust / foreclosure law expert.<br></p><p>I have a few rental properties that still have conventional financing on them. I am planning on deeding them each into their own land trusts, and then owner finance them to a few of my tenants who want to buy them for approx. $20k more than I owe, as well as pay about 2% higher interest rate than my current mortgages. This will work out well since I will no longer be the owner of the property, and not have any of the maintenance/management/tax/insurance expenses, but will pretty much be stepping into the role of the bank.</p><p>My question is this; is the process of foreclosing on the buyer any different than if I had owned the property outright and owner financed it without them being in a land trust? The buyer will be the beneficiary of the trust, so I am concerned that this may create extra hurdles when trying to foreclose on the buyer. I expect that one or two of the tenants will end up needing to be foreclosed on in a couple of years, so I am anticipating this as part of the cost of doing business.
